BooART Auction Terms — for bidders and buyers
Version 2026-07. These terms apply to every bid and every direct purchase ("buy now") in a BooART auction, in addition to BooART's general terms and conditions.
1. Bidding
- A bid is binding and cannot be withdrawn. The highest valid bid at the end of the auction (provided any reserve price is met) purchases the artwork.
- With auto-bidding, every automatically placed bid counts as placed by you, up to your stated maximum.
- BooART may invalidate bids in cases of abuse or obvious error.
2. Auction fee (buyer's premium)
- On top of the winning bid or buy-now price you pay an auction fee of 15% of the winning amount, including 21% VAT.
- Worked example: winning bid €500.00 → auction fee €75.00 (of which €13.02 VAT) → total excluding shipping €575.00.
- The payable total (bid + auction fee) is shown before you confirm your bid.
3. Shipping and pickup
- The auction price excludes shipping. After the auction you choose between pickup (free) or shipping.
- If you choose shipping, you will receive a shipping quote within 24 hours. The shipping amount is added to your total before you pay.
4. Payment
- An order is created for you immediately when the auction ends. Payment is due within 7 calendar days of the auction's end, online (incl. iDEAL) or by bank transfer in consultation with BooART.
- If payment is not received in time, BooART will contact you. BooART may then cancel the sale, offer the work to the next bidder, or relist it. Costs incurred may be recovered.
5. Buy now
If an auction has a buy-now price, using it concludes an immediate purchase at that price. All provisions above (auction fee, shipping, payment) apply.
6. Recording your acceptance
For every bid and buy-now action we record your acceptance of these terms together with the time, IP address and browser information, as evidence of the agreement (art. 6(1)(b) GDPR).
7. Right of withdrawal
The statutory public-auction exception to the right of withdrawal applies (art. 6:230p Dutch Civil Code). Questions? Contact BooART at info@booart.eu.
